Prenuptial Agreements: A prenuptial agreement establishes separate property rights for both spouses in property division matters should the marriage come to an end. They are signed by both parties prior to the marriage. Prenuptial agreements can also establish other terms of a divorce including spousal support and other considerations.
Postnuptial Agreements: These agreements cover much of the same material as prenuptial agreements. The difference is that they are signed after the parties are already married rather than before. Postnuptial agreements are often useful in the event of an inheritance or a second marriage late in life.
Separation Agreements: A separation agreement is often used when parties are contemplating a divorce but wish to try a separation before making a divorce final. They are similar to postnuptial agreements in that they are entered into during the marriage. The separation agreement is often used to divide the parties' property in anticipation of an upcoming divorce.
Marital Settlement Agreements: Either party may propose a marital settlement agreement before or during a divorce proceeding. It may be necessary to negotiate the terms of an agreement prior to the parties agreeing to all of the terms. Roberta Kohn has extensive experience protecting your interest in negotiating the terms of a marital settlement agreement. Once a divorce settlement agreement has been negotiated between spouses, a marital settlement agreement that contains all the terms of the divorce, including custody, child support, spousal support, property division and any other provisions must be signed by the parties.
Mediated Agreements: A popular alternative to traditional divorce proceedings is mediation. Mediation may be had prior to or at any time during your case. Courts typically require the parties to attend mediation prior to a final hearing. Mediated agreements may be reached on some issues or all of the issues in the case. Attorney Kohn will discuss the mediation process and prepare you prior to mediation. At mediation, both spouses would sit down with a mediator and work through all the issues that needed to be decided to finalize the divorce. The meeting may be had with the parties and their attorneys in one room or more often with the parties separated and the mediator going back and forth to try to bring the parties to an agreement. Once agreement had been reached on all issues, a mediated agreement is prepared, review and executed by both spouses.
